Terms & Conditions

Effective for all tuning, mechanical, and parts services at Tuned by Apex, 9/21 View Rd, Epping VIC 3076.

Workmanship Warranty

Tuned by Apex provides a 30-day workmanship warranty from the invoice date. We warrant that all ECU and TCU software calibrations will meet industry performance standards, and that any medium containing them will be free from defects for the warranty period.

This warranty covers the calibration work performed by our technicians. It does not extend to engine, drivetrain, or ancillary mechanical components that are subject to additional stress as a result of increased power output.

Warranty Exclusions

The warranty is void if failures result from any of the following:

  • Accident, abuse, or negligence by the vehicle owner or third party
  • Mechanical defects pre-existing or unrelated to the calibration
  • Non-standard modifications made after the tune without our knowledge
  • Incorrect or contaminated fuel grades
  • Faults in third-party hardware or components not supplied by Tuned by Apex

Performance tuning increases stress on engine and drivetrain components. The vehicle owner acknowledges and accepts that increased power output raises the likelihood of mechanical failures. Dyno testing is performed entirely at the owner's risk.

Limitation of Liability

To the maximum extent permitted by Australian Consumer Law, Tuned by Apex disclaims all implied warranties including merchantability and fitness for a particular purpose. Our liability in all circumstances is limited to the amount paid for the specific calibration service in question.

We are not liable for consequential or incidental damages including loss of use, loss of business income, personal injury, or vehicle damage — even where we have been advised of the possibility of such loss.

Intellectual Property

All ECU and TCU software calibrations produced by Tuned by Apex remain our intellectual property. Customers receive a limited, non-transferable licence to use the calibration in the tuned vehicle only.

Customers may not reproduce, distribute, sell, reverse-engineer, or extract calibration data from any file or platform provided by Tuned by Apex.

Booking Deposits

A non-refundable deposit is required to secure your booking. If you need to reschedule, we require a minimum of 48 hours' notice. Same-day cancellations or no-shows forfeit the deposit in full.

Vehicle Collection

Vehicles must be collected within 5 business days of completion. Storage fees apply for vehicles left beyond this period. Tuned by Apex accepts no liability for vehicles left on premises beyond the agreed collection date.

Futile Service Fee

A futile service fee applies when a booking cannot proceed due to circumstances outside our control, including but not limited to:

  • Vehicle arrives in an unroadworthy or unsafe condition
  • Pre-existing mechanical faults that prevent tuning
  • Non-standard or undisclosed modifications incompatible with the booked service
  • Incorrect or missing hardware at time of appointment

Technical Support

Remote tuning support is available for current operating systems and requires a reliable broadband connection. Customers are responsible for their own internet usage costs. Customers unable to follow remote assistance instructions may be required to attend the workshop in person.

Wholesale & Fleet Bookings

Workshop parties booking multiple vehicles act as authorised agents for individual vehicle owners and assume full responsibility for communicating these terms, vehicle specifications, and service charges to each owner.

Third-Party Referrals

Where Tuned by Apex refers customers to third-party service providers, we act solely as a referral agent and accept no responsibility for the quality, pricing, or outcomes of third-party work.
